McCain alleges City overcharged for services

McCain Foods Limited is pursuing damages from the City of Portage la Prairie for back payments relating to a wastewater treatment agreement between the two parties, a filing with the Manitoba Court of the Queen’s Bench states.

The court filing indicates McCain Foods is commencing action against the City for damages pursuant to various causes of action, contractual, tortuous or statutory, including breach of contract, negligence and other common law remedies for recovery of money.

The filing says McCain discovered within the last 12 months it has been making payments “far in excess of the amounts properly payable” to the City “for many years” in respect to agreements pertaining to waste water treatment facilities.

The City was served notice Aug. 19, 2016.

Both Mayor Irvine Ferris and City Manager Jean-Marc Nadeau said they did not know why McCain applied for the action.
Calls to McCain’s plant manager requesting comment went unanswered by Herald Leader press deadline.
